1. Acceptance of Terms
By installing, accessing, or using DayMark: Year Calendar to Track Vacations | Google™ (the "Extension" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Extension.
These Terms constitute a legally binding agreement between you ("User" or "you") and Viacheslav Mukha ("Developer", "we", "us", or "our"). Your use of the Extension indicates your acceptance of these Terms and any future modifications.
2. Description of Service
DayMark: Year Calendar to Track Vacations | Google™ is a browser extension that provides a year calendar view with the ability to:
- Create and manage custom events with color coding
- Display event statistics and analytics
- Integrate with Google Calendar (optional feature)
- Store data locally in your browser
- Customize calendar display preferences
The Extension is provided for personal, non-commercial use. The Developer reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. User Responsibilities
3.1 Acceptable Use
You agree to use the Extension only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Extension in any way that violates any applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the Extension
- Interfere with or disrupt the operation of the Extension
- Use the Extension to transmit any malicious code, viruses, or harmful data
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Extension for any commercial purpose without explicit written permission
3.2 Account and Data Responsibility
You are solely responsible for:
- Maintaining the confidentiality of your Google account credentials (if using Google Calendar integration)
- All activities that occur under your account
- Backing up your data as the Extension stores data locally and may be lost if the browser data is cleared
- Ensuring your use of the Extension complies with all applicable laws and regulations
3.3 Google Calendar Integration
If you choose to use the Google Calendar integration feature:
- You must comply with Google's Terms of Service and Privacy Policy
- You are responsible for managing your Google account permissions
- The Developer is not responsible for any issues arising from Google's services or API changes
- You may revoke access at any time through your Google account settings
4. Intellectual Property Rights
4.1 Extension Ownership
The Extension, including its code, design, graphics, text, and all other content, is owned by the Developer and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved.
4.2 User Content
You retain ownership of any data, events, or content you create using the Extension ("User Content"). By using the Extension, you grant the Developer a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service.
The Developer does not claim ownership of your User Content and will not use it for any purpose other than providing the Extension's functionality.
5. Disclaimers and Limitations of Liability
5.1 Service Provided "As Is"
THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
5.2 No Guarantees
The Developer does not guarantee that:
- The Extension will be available at all times or free from errors
- The Extension will meet your specific requirements
- Data stored locally will be preserved indefinitely
- Google Calendar integration will function without interruption
- The Extension is compatible with all browser versions or configurations
5.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data or User Content
- Loss of profits or business opportunities
- Service interruptions or unavailability
- Errors or bugs in the Extension
- Compatibility issues with browsers or other software
IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE EXTENSION (IF ANY) OR $0.00, WHICHEVER IS GREATER.
6. Data and Privacy
Your use of the Extension is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.
You acknowledge that:
- Data is stored locally in your browser and may be lost if browser data is cleared
- You are responsible for backing up your data if desired
- The Developer is not responsible for data loss due to browser updates, extension updates, or user actions
- Google Calendar integration is optional and subject to Google's terms and policies
7. Service Modifications and Updates
The Developer reserves the right to:
- Modify, update, or discontinue any feature of the Extension at any time
- Release updates that may change functionality or require data migration
- Suspend or terminate the Service for maintenance, security, or other reasons
- Change these Terms at any time, with notice provided through the Extension or website
Continued use of the Extension after such modifications constitutes acceptance of the updated Terms.
8. Termination
8.1 Termination by User
You may stop using the Extension at any time by uninstalling it from your browser. Uninstalling the Extension will remove all locally stored data associated with the Extension.
8.2 Termination by Developer
The Developer reserves the right to suspend or terminate your access to the Extension at any time, with or without cause or notice, for any reason, including but not limited to violation of these Terms.
8.3 Effect of Termination
Upon termination:
- Your right to use the Extension will immediately cease
- All locally stored data may be deleted
- Google Calendar integration will be disconnected
- Provisions of these Terms that by their nature should survive termination will remain in effect
9. Third-Party Services
The Extension may integrate with third-party services, including but not limited to Google Calendar. Your use of such third-party services is subject to their respective terms of service and privacy policies. The Developer is not responsible for:
- The availability, accuracy, or reliability of third-party services
- Any issues arising from your use of third-party services
- Changes to third-party APIs or services that may affect Extension functionality
10. Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Extension
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your User Content or any content you submit through the Extension
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer operates, without regard to its conflict of law provisions.
11.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the Extension shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, you agree to first contact the Developer at the contact information provided in these Terms to attempt to resolve the dispute.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of the Extension and supersede all prior agreements and understandings, whether written or oral.
14. Changes to Terms
The Developer reserves the right to modify these Terms at any time. Material changes will be communicated through:
- Extension update notifications
- Publication of updated Terms on the Extension's website
- Update of the "Last Updated" date at the top of these Terms
Your continued use of the Extension after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Extension.

16. Acknowledgment
BY USING DAYMARK: YEAR CALENDAR TO TRACK VACATIONS | GOOGLE™, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE EXTENSION.
